Depending on the technologies enabled on the Services, analytics may also include information about clicks, scrolling, navigation patterns, heatmaps or session interactions.
2. Where Information Comes From and How We Use It
We may obtain personal information directly from you, automatically through the Services, and from providers involved in Shopify ecommerce, payments, communications, fulfillment, shipping, reviews, fraud prevention, analytics, advertising and marketing.
We may use personal information where reasonably necessary to:
- operate the Services and process, fulfill and administer orders, subscriptions, returns and refunds;
- provide customer service and communicate about orders, accounts and the Services;
- send promotional email or SMS where appropriately authorized and maintain consent and opt-out records;

Certain information is necessary to complete transactions or provide requested Services. If necessary information is not provided, we may be unable to complete an order or provide the requested Service.
3. Cookies, Analytics, Advertising and Privacy Signals
Kind Mask and our providers may use cookies, pixels, tags, local storage and similar technologies for essential functionality, authentication, security, fraud prevention, shopping-cart operation, preferences, analytics, attribution, marketing and advertising.
Our analytics, advertising and marketing providers may include Google, Meta, Pinterest, TikTok, Microsoft, Shopify and Klaviyo. Depending on configuration, these providers may process device or browser identifiers, IP address, website activity, products viewed, cart activity, advertising interactions, purchases or other conversion events and campaign-attribution information.
Where applicable law requires consent before non-essential technologies are used, we seek that consent before those technologies are activated. Where applicable law provides a right to opt out of sale, sharing, targeted advertising or similar activities, we provide applicable privacy-choice controls.
We do not use purchase history, browsing activity or other personal information to infer an individual's health condition or to target advertising based on an individual's health condition.
Some privacy laws use terms such as "sale," "sharing," "targeted advertising" or "cross-context behavioral advertising" to describe certain advertising-related disclosures, including some circumstances in which no money is paid to Kind Mask specifically in exchange for personal information.
These disclosures do not include SMS opt-in data or SMS consent status, which are not shared with third parties except as described in the SMS and Text Messages section.
You may manage applicable cookie choices through our Cookie Preferences controls and applicable advertising or data-sharing choices through our Your Privacy Choices controls.
Where required by applicable law, we honor supported universal opt-out preference signals such as Global Privacy Control ("GPC") as an applicable opt-out request for the browser or device transmitting the signal. We do not currently treat ordinary browser Do Not Track signals as privacy requests except where applicable law requires otherwise.
Third-party analytics and advertising providers may collect information about interactions with the Services over time and, depending on the provider and configuration, across other websites or online services.
4. Email and SMS Marketing
We may use Shopify, Klaviyo and other providers to administer promotional email. You may unsubscribe at any time using the unsubscribe mechanism in our promotional emails.
Opting out of marketing does not prevent us from sending non-promotional communications reasonably necessary to administer an order, account, subscription, security matter, refund or other requested Service.
SMS and Text Messages
Kind Mask may offer promotional SMS communications to customers and subscribers in the United States and Canada through Klaviyo and related messaging providers.
SMS marketing is voluntary, and SMS consent is separate from email consent and is not a condition of purchase.
If you subscribe, we may process your mobile number, subscription status, date and method of consent, consent records, message activity, delivery information and opt-out requests. Message frequency may vary and message and data rates may apply.
You may withdraw SMS marketing consent at any time by replying STOP to a marketing message. Reply HELP for assistance. We will also process other legally recognized or reasonable revocation requests as required by applicable law.
Where you have separately opted into SMS, including completing any confirmation step we require, and an applicable flow is enabled, cookies or similar technology may be used to determine when a shopping cart has been abandoned and whether to send an SMS cart reminder.
We do not share mobile telephone numbers collected through our SMS program, SMS opt-in data or SMS consent status with third parties or affiliates for their own marketing or promotional purposes. We share this information only with service providers that help us deliver, operate or administer our messaging program, including Klaviyo, telecommunications carriers, messaging platforms and related service providers, or as required by law.
We may offer discounts or promotions associated with voluntarily subscribing to marketing communications. Where applicable law requires an additional notice concerning a qualifying financial incentive, loyalty program or similar arrangement, we will provide that notice in connection with the offer.

We may disclose personal information where reasonably necessary to operate our business and provide the Services, including to:
- Shopify and other ecommerce, hosting, technology and integration providers;

Planet of Kind is hosted by Shopify. Shopify processes personal information in connection with providing and supporting its ecommerce platform and related services and may, for certain activities, process information under its own privacy notices and legal obligations.These disclosures do not include SMS opt-in data or SMS consent status, which are not shared with third parties except as described in the SMS and Text Messages section.
6. Security and Retention
We use reasonable administrative, technical and organizational safeguards designed to protect personal information under our control against unauthorized access, use, alteration, disclosure, loss or destruction, taking into account the nature and sensitivity of the information and our operations.
No website, network, transmission method, database or storage system can be guaranteed to be completely secure.
We retain personal information only for periods reasonably necessary or permitted for the purposes for which it is processed. Retention may depend on the nature of the information, active customer relationships, transaction and payment records, customer service, fraud prevention, consent and opt-out records, tax and accounting obligations, statutory recordkeeping, limitation periods and actual or potential disputes or claims.
A deletion request does not necessarily require deletion of information that may lawfully be retained. Where permitted by law, we may retain information in aggregated, de-identified or anonymized form where it is no longer reasonably capable of identifying an individual.
7. International Processing and Transfers
Kind Mask uses service providers and technology infrastructure that may operate in Canada, the United States and other jurisdictions.
Personal information may therefore be transferred to, stored in or processed outside the jurisdiction where you reside, where privacy laws and lawful-access rules may differ.
Where EU or UK data-protection law applies to an international transfer and requires a transfer mechanism, we rely on an appropriate lawful mechanism, which may include an adequacy decision, Standard Contractual Clauses, a UK International Data Transfer Agreement or Addendum, or another mechanism permitted by law.
8. Your Privacy Rights and Requests
Depending on where you reside, which laws apply and the nature of our processing, you may have rights to access, know about, correct, delete or obtain a copy of certain personal information; restrict or object to certain processing; withdraw consent where consent is the legal basis; opt out of certain targeted advertising, sale or sharing; appeal certain privacy-request decisions; and exercise other rights provided by applicable law.
These rights are not absolute and may be subject to legal conditions, thresholds, verification requirements, exceptions, retention obligations and other limitations permitted by law.
Privacy requests may be submitted through our contact page at planetofkind.com/pages/contact or by contacting the Kind Mask Privacy Officer. Where permitted, an authorized agent may act on your behalf. We may request information reasonably necessary to verify identity or authority before completing a request.
We will respond without undue delay and within the period required by applicable law. Where applicable law permits an extension, we may extend the response period and provide any notice required by law.
We will not unlawfully discriminate against you for exercising an applicable privacy right.
9. United States Privacy Rights
Residents of certain U.S. states may have additional rights where the relevant law applies to Kind Mask. These may include rights to access, correct, delete or obtain personal information and to opt out of targeted advertising or qualifying sale or sharing.
Where applicable, you may exercise advertising and data-sharing choices through our Your Privacy Choices controls and supported opt-out preference signals such as GPC.
We may make privacy controls available more broadly than legally required. Making a control available does not necessarily mean that a particular state privacy law applies to Kind Mask or that a particular processing activity is characterized the same way in every jurisdiction.
10. Canadian and Quebec Privacy Rights
Where applicable Canadian privacy law applies, you may have rights to request information concerning personal information under our control and, subject to applicable exceptions, request access to or correction of that information.
Where consent is required, you may withdraw consent subject to applicable legal or contractual restrictions and reasonable notice.

Kind Mask has designated a Privacy Officer to oversee privacy inquiries and compliance.
Where applicable, you may also have the right to complain to the Office of the Privacy Commissioner of Canada or, for matters governed by Quebec privacy law, the Commission d'accès à l'information du Québec.
11. EEA and UK Privacy Rights
Where the EU GDPR or UK GDPR applies, we rely on an appropriate lawful basis for processing. This may include performance of a contract, compliance with legal obligations, legitimate interests or consent.
Our legitimate interests may include operating and improving the Services, protecting systems, preventing fraud, administering transactions, providing customer service, protecting legal rights and understanding business performance, where those interests are not overridden by applicable individual rights.
A legitimate-interest basis for a business purpose does not remove any separate consent requirement that applies to cookies or similar technologies.
Where EU or UK data-protection law applies, you may have rights including access, rectification, erasure, restriction, data portability, objection and withdrawal of consent, subject to applicable conditions and exceptions.
You may object at any time to processing for direct-marketing purposes where that right applies.
You may also have the right to complain to the competent EEA supervisory authority or the UK Information Commissioner's Office.
If Kind Mask is required by applicable law to appoint an EEA or UK representative, the representative's contact information will be made available through this Policy or our privacy resources.

We do not knowingly collect personal information directly from children under 13 or knowingly permit children under 13 to make purchases through the Services.
If we learn that we have collected personal information from a child under 13 without any authorization required by applicable law, we will take appropriate steps to delete or otherwise address that information.
Where Quebec law applies, any consent required in relation to a minor under 14 will be obtained from the person with parental authority or tutor, as required by law.
13. Business Transactions and Corporate Changes
Personal information may be disclosed, reviewed, assigned or transferred in connection with an actual or proposed financing, investment, merger, acquisition, restructuring, reorganization, incorporation, sale of shares or assets, insolvency, change of control or other corporate or business transaction, subject to applicable law.
A successor or acquiring entity may continue processing personal information as permitted by law and subject to any privacy notice then applicable.
14. Third-Party Websites and Services
The Services may contain links to, integrations with or functionality supplied by independently operated third-party websites, platforms or services.
We do not control those independent third parties and are not responsible for their independent privacy or security practices except to the extent responsibility is imposed on Kind Mask by applicable law.
Your interactions with those parties are subject to their own terms and privacy notices.

We may revise this Privacy Policy from time to time to reflect changes in the Services, technologies, providers, marketing programs, privacy controls, legal requirements, business operations, ownership or corporate structure.
